Security Deposit Return charges, seem high, can I fight them?

My landlord returned my scurity deposit along with a list of reasons some was withheld. Some of the reasons and amount are hard to fight, but some were ridiculous. They charged $40 each for carpet cleanings and said they had to clean it 3 times but they use their own machine, so you can’t tell me it cost $40 a cleaning. Another was $20 to wipe down the cupboards which there is only one and its about 4′ by 3′. Any chance of me arguing these in court?
All together just for carpet cleanings the total was $120

Did you know the things they were gonna charge you for beforehand? And was your place pretty clean or pretty dirty when you left? I don’t mean filthy or anything – I just mean – did you not give your place a good clean and scrub before you left?

If they had to pay someone to clear out your cabinets and clean them – they could charge for that, although I think $20 is a little steep to clean ONE cabinet ONE time. No one would think that was a reasonable price. Now, the question is – did you know this stuff cost that much beforehand?

The rug cleaning probably could be contested – IF you knew the rug was clean (i.e. you’d recently had it cleaned) and they could prove to you why they needed to clean it three times. I mean – did they clean it three times in one day? (which makes no sense unless) or three times in a row – like they cleaned it, it was still grimy when it dried. So they came back another day and cleaned it again. It was still grimy after it dried so they came back another day and cleaned it AGAIN.

This is why it helps to have pictures and a walkthrough when you first agree to move into a place – that way you can have proof of what the condition is like when you leave so that if they try to keep your security with bogus charges you can have proof. Otherwise – you may not be able to do anything. Unless your carpet was filthy – I can’t see them needing to clean it three times.

But are you willing to go to small claims court for that? It’s gonna be he said/ she said and if you don’t have proof to back up what you said – well, then you’ll have to add court costs and fees to the other money this has cost you. I say take it to court only if you can prove your case. If you can’t – waste of your time and money.

I guess the lesson learned is to really evaluate the place before you move in. I thought all landlords had people do an approval checklist so both parties can know what’s in good condition and what’s not. Then when you move out – you thoroughly clean the place and shampoo the carpet (if allowed) and wash anything that belongs to the landlord and the apartment. Then have him go through a day before you leave and review an “exit” checklist just like the one you did when you moved in. That way there’s an agreement as to what’s still in good condition and what’s gonna take additional maintenance before the place can be rented to someone new. If the place is basically in the same condition as when you started renting it – you should get your full deposit back. But when you don’t cover your butt like that – they can take advantage, because how can you prove what didn’t need to be done after the fact??? I’m sure you’re not the first person this has been done to, but please make sure it doesn’t happen to you again. Fool you once, shame on them. Fool you twice, shame on you. Fool you three times – well… there won’t be a third time, right?
